Terms of Service

1. Agreement to Terms

By accessing or using ASOgain ("the Service"), operated by CEPALabs SH.P.K. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

ASOgain is a software-as-a-service (SaaS) platform that provides App Store Optimization tools for iOS developers, including PPP pricing optimization, AI-powered metadata localization, keyword intelligence, and ASO auditing. The Service is accessible at asogain.com.

3. Accounts

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

You must be at least 18 years old to use the Service. By creating an account, you represent that you are at least 18 years of age.

4. Free and Paid Plans

ASOgain offers a free tier with limited features and paid subscription plans with enhanced capabilities. The features and limits of each plan are described on our pricing page.

We reserve the right to modify the features, limits, and pricing of any plan at any time. Existing subscribers will be notified of material changes at least 30 days in advance.

5. Payments and Billing

Paid subscriptions are billed through Lemon Squeezy, our merchant of record. By subscribing to a paid plan, you agree to Lemon Squeezy's terms of service. Lemon Squeezy handles all payment processing, invoicing, and applicable tax collection (including VAT/GST).

Subscriptions renew automatically at the end of each billing cycle (monthly or annual) unless cancelled before the renewal date. You can cancel your subscription at any time from your account settings.

6. Cancellation

You may cancel your subscription at any time. Upon cancellation, you retain access to your paid plan features until the end of the current billing period. After that, your account reverts to the free plan.

We reserve the right to suspend or terminate accounts that violate these terms, without refund.

8. App Store Connect Integration

The Service allows you to connect your Apple App Store Connect account using API keys. You are solely responsible for the API keys you provide. We encrypt your private keys at rest using AES-256-GCM encryption and never transmit them to your browser.

We are not responsible for any changes made to your App Store listings through the Service. You should review all metadata and pricing changes before pushing them to App Store Connect.

9. AI-Generated Content

The Service uses artificial intelligence to generate metadata suggestions, audit reports, and other content. AI-generated content is provided as suggestions only. You are responsible for reviewing, editing, and approving all content before publishing it to the App Store.

We do not guarantee the accuracy, completeness, or effectiveness of AI-generated content. You retain full ownership of the content you create using the Service.

10. Intellectual Property

The Service, including its code, design, branding, and documentation, is owned by CEPALabs SH.P.K. and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

You retain ownership of your data, including your app information, metadata, and analyses. We do not claim any intellectual property rights over your content.

11. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to send spam or abuse App Store systems
  • Resell or redistribute the Service without authorization
  • Use automated tools to scrape or access the Service beyond normal use

12. Limitation of Liability

To the maximum extent permitted by law, CEPALabs SH.P.K. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.

15. Governing Law

These Terms are governed by the laws of the Republic of Albania. Any disputes shall be resolved in the courts of Tirana, Albania.
